    User Rights and Data Deletion

    Users may request deletion of their application account through the Request Account Deletion option available within the application. We may verify the identity and authority of the requesting individual before processing the request in order to protect Protected Health Information (“PHI”), electronic Protected Health Information (“ePHI”), Electronic Health Information (“EHI”), and other sensitive information from unauthorized access, alteration, or deletion.

    Upon verification of a valid request, we will delete, deactivate, or otherwise disable the user’s application account and associated application-specific information that is no longer required for the operation, security, administration, or legal compliance of the
    application. This information may include login credentials, active authentication sessions, device registrations, application preferences, and other information maintained solely to enable access to or use of the application.

    Healthcare and Medical Records

    Deletion of an application account does not necessarily result in the deletion of medical, clinical, billing, claims, or other healthcare records. Certain healthcare information may be retained where required or permitted by applicable federal or state law, healthcare record-retention requirements, regulatory requirements, contractual obligations, or
    legitimate healthcare operations.

    Information that may be retained includes, but is not limited to:

    • Medical and clinical records
    • Treatment and care-coordination information
    • Provider documentation
    • Patient-provider relationship records
    • Billing and claims information
    • Payment and reimbursement records
    • Audit and security logs
    • Records necessary for fraud prevention, investigations, litigation, or dispute resolution, and other records maintained by or on behalf of healthcare providers, Accountable Care Organizations (“ACOs”), health plans, Business Associates, or other healthcare organizations.

    HIPAA and HITECH Compliance

    Where applicable, PHI and ePHI that is retained following account deletion will continue to be maintained and protected in accordance with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), the HIPAA Privacy, Security, and Breach Notification Rules, and the Health Information Technology for Economic and Clinical Health Act (“HITECH Act”).

    Account deletion is separate from an individual’s rights regarding healthcare information. Subject to applicable law, individuals may have rights to access, inspect, obtain copies of, and request amendment of PHI maintained in a designated record set.

    Nothing in this policy should be interpreted as creating a general right to require deletion of medical or healthcare records where those records are required or permitted to be retained under applicable law.

    Health Information Technology and the 21st Century Cures Act

    Where applicable, the application and participating healthcare organizations will also handle EHI consistent with applicable provisions of the 21st Century Cures Act, regulations issued by the Office of the National Coordinator for Health Information
    Technology (“ONC”), and applicable interoperability and information-blocking requirements.

    Account deletion will not be implemented in a manner intended to unlawfully interfere with an individual’s rights to access, exchange, or use EHI where such access, exchange, or use is required under applicable law.

    Nothing in this section requires the deletion of EHI that a healthcare provider, ACO, health plan, Business Associate, health information network, health information exchange, or other organization is legally required or permitted to maintain.

    Protection and Secure Disposal of Retained Information

    Information retained following account deletion will remain subject to applicable privacy, security, confidentiality, and data-protection requirements. Where applicable, reasonable and appropriate administrative, physical, and technical safeguards will continue to be used to protect PHI and ePHI against unauthorized access, use, disclosure, alteration, or destruction.

    When applicable legal, regulatory, contractual, and organizational retention requirements have expired, information will be securely destroyed, deleted, or otherwise disposed of in accordance with applicable law and established record-retention and secure-disposal procedures.

    Effect of Account Deletion

    Deleting or deactivating an application account terminates the user’s access to the application through that account. Account deletion does not alter, remove, or require the destruction of medical, clinical, billing, claims, audit, or other healthcare records that a healthcare provider, ACO, health plan, Business Associate, or other healthcare organization is required or permitted to maintain.

    Account deletion also does not limit any rights an individual may have under HIPAA or other applicable federal or state law to access or request amendment of their healthcare information.
